Michigan Minor in Possession of Alcohol Defense Attorney

Just like any other criminal case, the first question that must be answered is whether your child is actually innocent of being a Minor in Possession of Alcohol, called an MIP. 

In order to be convicted, the Prosecutor or City Attorney must prove that your son or daughter is (1) under 21 years of age and (2) possessed alcohol (either actually or constructively).  Assuming your child wants to accept responsibility for having alcohol, the law provides for a discharge and dismissal for a first offense in some cases.  Depending on the local practices of your district court, your lawyer may be able to secure a delayed judgment of guilt within the plea agreement itself.  Assuming your son or daughter has not previously been convicted of, or received a juvenile adjudication for, a violation of the MIP laws, your lawyer might be able to convince the sentencing judge to defer further proceedings and place your son or daughter on probation.  The probation terms and conditions will include the payment of fines and costs as provided under the Code of Criminal Procedure and a payment of a probation supervision fee.   The court will maintain a nonpublic record of the arrest, admission, drug or alcohol treatment, and community service requirement while proceedings are deferred and the individual is on probation.
